First Amendment to the Declaration
(allowing small, personal-use pick-up trucks to be parked on premises)

        The Declaration is hereby amended at Paragraph 14, Sub paragraph (h), entitled "Use Restrictions: Parking," by deleting the second paragraph of Subparagraph (h) in its entirety and replacing it with a new second paragraph to read as follows:

        Disabled and stored vehicles are prohibited from being parked on the Condominium.  Boats, trailers, panel trucks, pick-up trucks and/or trucks with a rated load capacity of more than one-half (1/2) ton as provided herein, vans (excluding mini-vans or utility vehicles used as passenger vehicles and receiving a "car" or "passenger vehicle" classification by the Georgia Department of Motor Vehicles), recreational vehicles (RV ' s and motor homes), vehicles used primarily for commercial purposes, and vehicles with commercial writings on their exteriors are also prohibited from being parked on the Condominium, except in other areas, if any, designated by the Board as parking areas for particular types of vehicles.  Notwithstanding the above, other trucks, vans, commercial vehicles and vehicles with commercial writings on their exteriors shall be allowed temporarily on the Common Elements during normal business hours for the purpose of serving any Unit or the Common Elements; provided, that no such vehicle shall be authorized to remain on the Common Elements overnight or for any purpose except serving a Unit or the Common Elements, without written Board consent. It is the intent of this provision to allow personal use pick-up trucks which are used as a regular means of non-commercial transportation with a rated load bearing capacity of one-half (1/2) ton or less to be parked on the Condominium subject to all other applicable provisions herein. The Board of Directors expressly reserves the exclusive right to determine by Resolution whether certain types of vehicles shall be allowed on the Condominium pursuant to this provision.
